Laura’s Case

Laura’s case or cause of action against Brock is that Brock breached the contract they had and that the latter agreement which they signed to release Brock from being bound by the original agreement is invalid since it was vitiated by undue influence and duress. In her case, Laura relies on the fact that Brock lied to her about his mother and that she only agreed to terminate her purchase agreement with Brock because she felt pressured and threatened by his belligerent phone calls. She may also base her action on the fact that Brock put a "sold" sign on the chair indicating that it was already sold to Laura and hence he could not purport to resell it to Andrew just because Andrew offered more money than Laura.

Brock’s Position

Brock's position is that he faces a potential lawsuit in which Laura is seeking damages for breach of contract, a rectification of the invoice, punitive damages, an injunction to prohibit the sale of the chair to Andrew, and specific performance of the sale agreement. This puts Brock in a very precarious situation since the facts and evidence seem to be in the favor of Laura given also that the agreement with Laura in which Laura forfeited her right over the chair was procured by undue influence due to the incessant phone calls that Brock made to Laura.
