Race and the criminal justice system are somehow intertwined and particularly when it comes to sentencing, racial inequality tends to play out. There are various reasons or factors that explain why there are racial disparities in the criminal justice system, especially regarding sentencing.
According to a report by Kansal and Mauer from the Sentencing Project, a review of the literature on racial inequality and disparity in the criminal justice system show reveals various key findings (2). One of these findings which explains the inequality is the fact that compared to other offender populations, Latino and Black offenders are more likely to be subjected to harsh sentencing. The other reason is that racial minorities are disadvantaged when it comes to legal process related factors like type of attorney, pretrial detention, criminal history, and sentence reduction. An offender from racial and ethnic minority communities also tend to suffer harsher penalties than their white counterparts thus creating the disparity. They are also often severely sentenced and are more likely to receive the death penalty where the victim is white than White offenders.
Furthermore, according to the American Civil Liberties Union (ACLU), racial disparities or inequalities in sentencing are due to decisions by prosecutors during the initial stages of a trial (8).
