In a hazing incident in a locker room caught on camera at Davidson High School, Rodney Kim Jr., a fourteen-year-old freshman was brutally beaten by members of his own football team (Wash, 2018). As a result of the attack, the freshman quarterback suffered bruises on his back, busted lip, and a broken arm. He requires surgery on his broken arm. His parents are now calling on the school to fire the school football coach.
The main legal issue at hand is whether the school’s football team can be held “vicariously” liable or responsible for the violent and criminal acts of members of his team even though he does not aid or abet the attack. The incident also raises the legal issue of the responsibility of schools to keep students safe from harassment and bullying.
The governing body which might rule on this issue is the National School Board Association which is the body charged with ensuring the safety and security of students and teachers in public schools.
If the issue is litigated in courts, what the courts might rule is that the management of the school together with its football coach failed to ensure that such violent incidents do not occur among its students. The courts will thus hold the school heads responsible since they neglected their duty to endure the safety of all students. As a result, the school board and the coach may be required by the court to pay for Rodney's medical expenses including the arm surgery.
